INVITATION TO SERVE ON THE COMPLAINTS AND COMPLIANCE COMMITTEE (CCC) OF THE INDEPENDENT COMMUNICATIONS AUTHORITY OF SOUTH AFRICA: THREE (3) POSITIONS
The Independent Communications Authority of South Africa (ICASA) is a Chapter 9 institution established under section 192 of the Constitution of the Republic of South Africa. ICASA is responsible for the regulation of the electronic communications, broadcasting and postal industries in South Africa, as mandated by the Independent Communications Authority of South Africa Act, 2000 (Act No. 13 of 2000) (ICASA Act), and Electronic Communications Act, No 36 of 2005 (ECA).
The ICASA Council hereby calls on all independent, suitably qualified and interested persons to apply to serve as members of its Complaints and Compliance Committee (“CCC”), for a period of three (3) years. A member of the Complaints and Compliance Committee (“CCC”) must be fit and proper in accordance with section 17A (4) of the ICASA Act.
Applicants must be South African citizens.
Role and Responsibilities: In terms of sections 17B, 17C and 17D of the ICASA Act the CCC is vested with an obligation and powers to, amongst others, investigate, hear if appropriate, and make findings on all matters referred to it by the Authority including complaints and allegations of non-compliance with the applicable Acts and make recommendations to the Authority on what action should be taken by the Authority.
CCC MEMBERS
In terms of section 17A (4) a member of the Complaints and Compliance Committee must be a fit and proper person and must—
- have suitable qualifications and experience in communications, economics, electronic engineering, broadcasting, law, commerce, technology or public policy;
- be committed to the objects of this Act and the underlying statutes;
- not be an office-bearer or an employee of any party, movement or organisation of a party-political nature;
- not be an unrehabilitated insolvent;
- not be mentally ill or disordered;
- not have been convicted of an offence after the commencement of the Constitution of the Republic of South Africa, 1993 (Act No. 200 of 1993) and sentenced to imprisonment without the option of a fine; and
- not be subject to any disqualification contemplated in section 6 and be subject to the provisions of section 12.
Prospective candidates must possess one of the following expertise: -
1. ENGINEERING
Required qualifications: The applicants must be in possession of a postgraduate degree in Electronic Engineering / Electrical Engineering / Engineering and Technology Management or any related degree in the same field.
Experience:
- More than ten (10) years’ experience in the electronic communications network and services environment.
- Knowledge of radio frequency spectrum management, electronic communication numbering system, interconnection, facilities leasing, digital technologies, data communications, networking and digital electronic systems and related fields will be an added advantage.
- Knowledge of the legislative instruments regulating the electronic communications, broadcasting and postal in South Africa.
Required qualifications: The applicants must be in possession of a postgraduate degree in Economics or related qualification in the same field.
Experience:
- More than ten (10) years’ experience in Economics, cost management models; accounting principles and practices, financial data analysis and reporting.
- Knowledge of electronic communication networks and services environment, numbering systems, interconnection, facilities leasing, digital electronic systems and related fields will be an added advantage.
- Knowledge of the legislative instruments regulating the electronic communications, broadcasting and postal in South Africa.
3. BROADCASTING
Required qualifications: The applicants must be in possession of a postgraduate degree in Media and Communications Studies or related degree in the same field.
Experience:
- More than ten (10) years’ experience in line with the tenets of the Broadcasting Act No.4 of 1999 of South Africa.
- Knowledge of media management, digital media / platforms, broadcasting content, media ethics, Public/Free-to-Air, Community, Commercial/Private Broadcasting systems, Broadcasting Signal Distribution.
- Knowledge of the Broadcasting legislative environment regulating the sector in South Africa.
4. LAW
Required qualifications: The applicant must be an admitted attorney or advocate of the High Court of South Africa.
Experience:
- More than ten (10) years’ legal experience in South Africa.
- Knowledge and expertise to investigate and adjudicate complaints and disputes relating to the electronic communications, broadcasting and postal sector, weighing evidence and drafting findings.
- Deep knowledge of the legislative instruments regulating the electronic communications, broadcasting and postal in South Africa; including administrative law to ensure lawful, reasonable and procedural fairness.
Remuneration: CCC Members will be paid such remuneration allowance as the Council of the Authority determines, in terms of Section 17(8) of the ICASA Act No. 13 of 2000 as amended. As per Treasury Regulation 20 under Government Notice No. R. 225, published in Government Gazette No. 27388 of 15 March 2005, persons employed by state organs or those serving on such Commissions and Committees of Inquiry will not be entitled to additional remuneration or fees payable for partaking in the work of the CCC.
Disqualification in terms of section 6 of the ICASA Act is applicable
Selection Procedure: Short-listed candidates will be invited for interviews, to be conducted by a panel appointed by the ICASA Council. It will be the prerogative of the Council to make the final appointment upon recommendation by the selection committee.
Term of Office: The successful candidates will be appointed for a three-year term of office, which is renewable for one additional term only, and will be subject to the CCC Terms of Reference and such other terms and conditions as prescribed by law and the Council of the Authority.
